This Privacy Notice for FertiNutrition (“we,” “us,” or “our”) describes how and why we may access, collect, store, use, and share personal information when you use our website, our mobile application, or engage with us in related ways.

1. What information do we collect?

Personal information you disclose to us

We collect personal information that you voluntarily provide when you register for the Services, express interest in FertiNutrition, use app features, join the launch list, or contact us.

The personal information we collect may include:

  • names;
  • email addresses;
  • usernames;
  • passwords;
  • contact preferences.

Sensitive information

When necessary, with your consent or as otherwise permitted by law, we may process the following sensitive health and reproductive health data:

  • Cycle data — menstrual cycle start dates, cycle length, regularity, and predicted phase information.
  • Fertility tracking data — cervical mucus observations, ovulation (LH) test results, basal body temperature (BBT) readings, and symptom logs (such as cramping, mood swings, breast tenderness, fatigue, or bloating).
  • Sexual activity logs — dates of intercourse and whether protection was used, only when you choose to log them.
  • Nutrition entries — meals logged, food photos taken, and nutrient totals.
  • Body measurements — weight history and target weight.
  • Apple Health data — sleep, wrist temperature, period and menstrual flow data, and weight data synced read-only from Apple Health when you connect HealthKit.
  • Personal notes — free-text notes you write in fertility log entries.

This data is stored in your encrypted account in our secure database. It is used only to provide and personalize the Services. It is not used for advertising, not shared with data brokers, and not used to track you across other companies’ apps or websites.

Payment data

Payment and subscription data is handled by Apple and RevenueCat. We do not directly store full payment card details. Their privacy notices are available at apple.com/legal/privacy and revenuecat.com/privacy.

Application data

If you use the iOS app, we may request access to device features such as the camera (for meal photos and barcode scanning), photo library (to choose meal photos from your library), push notifications, Apple Watch, and Apple Health. You can change these permissions in your device settings at any time.

We may also collect device data such as device model, operating system, app version, identifiers, browser type, IP address, crash data, and information about app features you access. This is primarily used to maintain security, operate the Services, troubleshoot issues, and improve the product.

Information automatically collected

When you visit, use, or navigate the Services, some technical information may be collected automatically, including IP address, browser and device characteristics, operating system, language preferences, referring URLs, pages viewed, timestamps, and similar log and usage data.

Google API

Our use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

Information collected from other sources

We may collect limited information from public databases, marketing partners, social media platforms, and other outside sources to keep our records accurate, respond to inquiries, or provide relevant communications. If you interact with us through social media, the data we receive depends on that platform and your settings.

2. How we use fertility tracking data

Fertility tracking is a sensitive feature, and we want to be explicit about how we handle this data:

  • Your fertility logs (cervical mucus, LH test results, BBT, symptoms, intercourse history, and notes) are stored in your encrypted account. Only you can access them through your authenticated session.
  • We use this data to compute personalized predictions — including your average cycle length, ovulation timing, fertile window, and luteal phase length — so we can give you smarter insights than a generic 28-day default.
  • We do not analyze your fertility data for any purpose other than providing the Services to you. We do not aggregate or anonymize it for research without your specific, separate consent.
  • We do not share fertility data with insurance companies, employers, advertising networks, data brokers, or any other third party. This data never leaves your account except when you explicitly choose to export it.
  • You can delete all fertility data at any time by deleting your account from the in-app Settings, or by emailing privacy@fertinutrition.com. All linked fertility logs are permanently removed.
  • If you are in a jurisdiction where reproductive health information has specific legal protections (for example, certain US states or GDPR Article 9 in the EU), you have additional rights to access, restrict processing of, and delete this data. We will honor these rights without retaliation.

3. How do we process your information?

We process personal information to:

  • create, authenticate, and manage user accounts;
  • deliver and facilitate the Services;
  • generate personalized cycle insights — including predicted ovulation, fertile window, and personal baselines (average cycle length, luteal phase, BBT) calculated from your own data over time;
  • detect anomalies in your cycle patterns — for example, late ovulation or unusual cycle length — so we can surface relevant information to you;
  • combine multi-signal fertility data — your LH test, cervical mucus, BBT, and Apple Watch temperature data are analysed together to provide more accurate ovulation timing than any single signal alone;
  • fulfill and manage subscriptions and payments;
  • request feedback and respond to support requests;
  • protect the Services, including fraud monitoring and prevention;
  • identify usage trends and improve the product experience;
  • save or protect an individual’s vital interests where necessary;
  • comply with applicable legal obligations.

4. What legal bases do we rely on?

If you are located in the EU, EEA, UK, or Switzerland, we process personal information only when we have a valid legal basis, including:

  • your consent, which you may withdraw at any time;
  • performance of a contract with you;
  • our legitimate interests, when not overridden by your rights;
  • compliance with legal obligations;
  • protection of vital interests.

For sensitive health and reproductive health data (Article 9 GDPR), we rely on your explicit consent, which you grant by choosing to log this data in the app. You may withdraw consent at any time by deleting the relevant logs or your account.

If you are located in Canada, we may process your information with express or implied consent, or without consent where applicable law permits, such as for fraud prevention, investigations, legal compliance, or other permitted circumstances.

5. When and with whom do we share your information?

We may share personal information with vendors, consultants, and other third-party service providers who perform services for us or on our behalf. These may include:

  • AI platforms (for food photo recognition only);
  • cloud computing services;
  • data storage providers;
  • payment processors;
  • user account registration and authentication services;
  • website hosting providers.

We do not share your fertility tracking data, cycle data, sexual activity logs, or any reproductive health information with AI providers or any other third party. This data stays in our secured database.

We may also share or transfer information in connection with a merger, sale of assets, financing, or acquisition of all or part of our business. If this happens, we will provide notice and ensure continuity of the same privacy protections.

6. Do we offer artificial intelligence-based products?

The FertiNutrition app may include features powered by artificial intelligence, machine learning, or similar technologies. For example, photo recognition may use image analysis to help identify food.

We provide AI Products through third-party service providers, including Google Cloud AI. Your input, output, and related personal information may be shared with and processed by these providers to enable those features. Fertility tracking, cycle data, and reproductive health information are never sent to AI providers. You can opt out of AI features by contacting us at privacy@fertinutrition.com.

7. How do we handle your social logins?

If the Services offer social login (such as Sign in with Apple or Sign in with Google) and you choose to register or log in using a third-party account, we may receive profile information such as your name, email address, profile picture, and other information made available by that provider. We use it only for the purposes described in this Privacy Policy or made clear to you.

8. How do we use Apple HealthKit?

FertiNutrition can optionally connect to Apple HealthKit on iOS devices to give you a more accurate, personalized experience.

Data we read from Apple Health (only with your permission)

  • Menstrual cycle and flow data;
  • Wrist temperature (from Apple Watch);
  • Sleep analysis;
  • Body weight;
  • Cycle-related symptoms you log in Apple Health.

Data we write to Apple Health (only when you log it in FertiNutrition)

  • Meal nutrient totals (calories, protein, folate, iron);
  • Body weight.

HealthKit data is processed on your device and synced to our servers only when you actively use cycle tracking, nutrition tracking, or related features. We never share HealthKit data with advertising networks or data brokers. You can revoke HealthKit access at any time in iOS Settings → Privacy & Security → Health → FertiNutrition.

Per Apple’s HealthKit policy, we will never use HealthKit data for advertising, data mining, or any purpose other than providing the health and fitness features of the app.

9. Is your information transferred internationally?

Our servers and service providers may be located in the United States, the European Union, and other countries. If your information is transferred internationally, we take measures designed to protect it in accordance with this Privacy Policy and applicable law, including Standard Contractual Clauses where appropriate.

10. How long do we keep your information?

We keep personal information only for as long as necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. No purpose in this notice requires us to keep account information longer than the period in which you have an account with us, unless law requires otherwise.

When you delete your account, all your fertility logs, cycle data, intimacy logs, nutrition logs, weight history, and other personal data are permanently deleted within 30 days. Some backup snapshots may be retained for up to 90 days before final deletion, after which all copies are permanently removed.

When we have no ongoing legitimate business need to process personal information, we delete or anonymize it, or securely store and isolate it until deletion is possible.

11. How do we keep your information safe?

We use reasonable technical and organizational measures designed to protect personal information, including encryption in transit (TLS), encryption at rest, row-level security on our database (so only you can access your own data), and access controls on production systems. However, no electronic transmission or storage technology can be guaranteed to be 100% secure, so use of the Services is at your own risk.

12. Do we collect information from minors?

We do not knowingly collect, solicit, sell, or market personal information from children under 18 years of age or the equivalent age specified by law in your jurisdiction. If you believe we have collected information from a minor, contact privacy@fertinutrition.com.

13. What are your privacy rights?

Depending on where you live, you may have the right to request access to your personal information, correction, deletion, restriction, portability, objection, withdrawal of consent, or human review of certain automated decisions. We will consider requests in accordance with applicable data protection laws.

You may exercise privacy rights by emailing privacy@fertinutrition.com. If you are in the EEA, UK, or Switzerland, you may also have the right to complain to your local data protection authority.

Account information

If account settings are available in the app, you may review or update account information there. You can delete your account — and all associated data including fertility logs, cycle data, and intimacy logs — from in-app Settings. Upon request to terminate an account, we deactivate or delete information from active databases, subject to retention needed for fraud prevention, troubleshooting, investigations, enforcement, and legal compliance.

14. Controls for do-not-track features

Some browsers and mobile systems include a Do-Not-Track feature. There is not yet a uniform standard for recognizing these signals, so we do not currently respond to DNT browser signals. We do not track users across third-party apps or websites regardless.

15. Do United States residents have specific privacy rights?

Residents of certain US states may have rights to know whether we process personal data, access data, correct inaccuracies, request deletion, obtain a copy, opt out of targeted advertising, sale, or profiling, limit certain sensitive data uses, and avoid discrimination for exercising privacy rights.

We have not sold or shared personal information to third parties for a business or commercial purpose in the preceding twelve months. We may disclose personal information to service providers pursuant to written contracts.

How to exercise US privacy rights

Email privacy@fertinutrition.com. We may need to verify your identity before responding. Authorized agents may submit requests where permitted by law, but we may require proof of authorization.

California “Shine The Light” law

California residents may request information about categories of personal information disclosed to third parties for direct marketing purposes during the preceding calendar year, if any.

16. Do we make updates to this notice?

Yes. We may update this Privacy Policy from time to time. The updated version will be indicated by a revised date at the top of this page.

18. How can you review, update, or delete your data?

Based on applicable laws in your country or state of residence, you may request access to the personal information we collect from you, details about how we process it, correction of inaccuracies, deletion, or withdrawal of consent. To make a request, email privacy@fertinutrition.com.

You can also delete your account and all associated data — including all fertility tracking logs, cycle data, intimacy logs, nutrition history, and personal notes — directly from the iOS app under Settings → Delete account. Deletion is permanent and cannot be undone.
